   himself assumed and to the Said Plt then and there last mentioned ——
   faithfully promised that he the Said Deft So much Merchantable Tobacco
   as the afd Liquors and ordinary Accomodations Sold and delivered as -
   afd at the time of the Safe and delivery thereof were at reasonable
   rates & prices worth and Amounted to into the afd Plt when——
   thereunto required would well & truly pay and Content and the afd —
   Plt in deed Saith that the afd Liquors and ordinary Accomodations
   Sold and delivered as afd at the time of the Sale & delivery thereof at
   reasonable rates and prices were worth and Amounted unto the Sum
   of Six hundred and five pounds of Merchantable Tobacco in man:
   :ner as in the Said Account Set forth of which the Said Deft~ then
   and there last mentioned by the Said Plt had Notice Nevertheless
   the afd Deft~ his Several promises and assumptions afd in forme afd
   made little regarding but Machinating and fraudulently intending y.e
   Said Plt. in that behalf to deceive and defraud ye afd Sumons of Tobo.
   in the whole amounting to nine hundred and Six pounds of Mercha:
  :table Tobacco to the Said Plt altho’ afterwards viz the third day of~
   January in the Year last mentioned he the Said Deft~ was at St Pauls
   Parish in Kent County afd within the Jurisdiciõn afd thereto required
   hath not paid nor made Content for the Same but that to pay or
   Content the Said Deft hitherto hath deneyed and yet denys to ye
   damage of the Said Plt Twelve hundred pounds of Merchantable
   Tobacco and thereupon he brings Suite &ca TBowne pr Quer pls.
