   137                                   March Court 1716
   being called came And the Said Plt by his afd att^ry prays that the said Deft
   may give Speciall baile to the afd^acconwhich is granted And that he be ket in
   Safe Custody by W^m Frisby Gentⁿ Sherf of Said County untill he Shall give—
   Special baile as afd :    And the Said Deft Saith that he cannot gainsay
   the accõn afd of him the Said Plt nor but that he is indebted to the
   Said Plt as above declared and is willing that Judgment Should be
   entred for the Same and Cost thereon accruing == Therefore it
   is Considered by the Court here viz^t this twenty Second day of—
   March Anno Domⁱ One Thousand Seven hundred and Sixteen
   That the Said Plt Samuel Hunter do recover against the Said
   Deft Philip Eilbeck as well the afd Sume of Nine hundred and
   Six pounds of Tobacco Damages on Acco^t. of the Said Deft~ his not
   performing his promises and assumptions afd as also the Sume of
   Three hundred and nineteen pounds of Tobacco Cost by the Said
   Plt about his Suite in this behalfe Expended and by the Court~.
   here of his assent adjudged and the Said Deft in mercy &c^a

   of Chester in Said County to Answer unto James Harris late Sheriff
   of Kent County afd a plea that he render to him y^e Sum of Six hundred
