135 March Court 1716 made return thereof in these words thereon Endorsed as folls vizt. Cepi Corpus pr Wm Ffrisby Sherf And now at this Court came the Said Plt by his Thomas Bowne his attry and prays that he might put Security to ye Sd Accon in the Plt not dewler in this County which is granted on which the afd. Thomas Bowne comes into Court and Saith that he will be Security for the Said Plt in the Said Accõn that is to Say if the afd Deft Shall appear to ye above accõn and the Plt Shall be non Suited That then he will pay the Cost himselfe on which the Said Plt by his attry afd files a decln which folls vizt Kent County Ss Philip Eilbeck of Kent County Glaizer was attaiched to Answer unto Samuel Hunter of a plea of Trespass upon ye Case And Whereupon the afd Plt by Thomas Bowne his attorney Complains for that whereas the afd Deft the Seventh day of November Anno Domini Seventeen hundred and fifteen at St. Pauls Parish in Kent County afd within the Jurisdicion of this Court In Consideration that the Said Plt at the Speciall instance & request of the Said Deft~ and to the only use of the Said Deft had then and there paid to divers persons divers Severall Sums of Tobacco in an Acco.t thereto annexed Set forth amounting in the whole to three hundred and One pounds of Merchantable Tobacco upon himselfe assumed and to the Said Plt then and - there faithfully promised that he the Said Deft the afd Three hundred and one pounds of Tobacco to the the Said Plt when thereunto required would well and truly pay & Content And that whereas also the afd Plt. for a Long time viz from the year of our Lord Christ~. Seventeen hundred and Seven untill this time was and yett is an approved Inholder and ordinary keeper and So Sold and delivered to the Inhabitants of this Province and other persons Liquors and other ordinary Accomodations and during which Said time of the Said Plts So keeping Inn and ordinary as afd that is to Say the Eighth day of November Anno Domi Seventeen hundred & fifteen at Queens Town in the County of Queen Annes in the Parish of S.t Pauls in Kent County afd within the Jurisdiciõn of this Court the Said Deft~ In Consideration the Said Plt at the like Special Instance and request of the Said Deft~ had then and there last mentioned Sold and delivered to the Said Deft to the use of the Said Deft divers Liquors and other ordinary Accomodations in an Accot. hereto Annexed Specifically Shewn upon himselfe~ |
