                                         March Court 1716                                    124 
   and acknowledges himselfe as Special baile in the afd Accõn and doth—
   undertake the Payment of the Damages and Cost Accruing if in case ye
   afd Plt Shall obtaine Judgment against the Said Deft in the Said —
   Accõn of Trespass upon ye Case and the Deft afd the Condemnation
   Shall not Satisfie nor himselfe to the Custody of the Sherf of Said County
   deliver or that the afd Michael Miller the body of the Said Thomas —
   Hues Shall not render &ca.
      The afd Thomas Hues in his proper person appears to the afd Accon and
   prays liberty thereof to imparle thereto and to answer at next Court which
   is granted the Same day is given the Plt. also
   Peter Williams | Charles absolute Lord and Proprietarie of the
           at | Province of Maryland and Avalon Lord Baron
   John Hodges — | of Baltemore &ca To the Sherf of Kent County


greeting wee Command You that you attach any
   the goods Chattells rights or Credits of John Hodges of Kent County —
   Mariner if they Shall be found in your Bailiwick to the value of forty
   five Shillings Currant money and five hundred pounds of Tobacco and
   when you have the Same So attached or any part thereof the Same
   in your Custody keep So that you have them before the Justices of our
   next County Court to be held at our Court house in the Town of Chester
   in Said County on the third tuesday in March next then and there to be
   Condemned According to Act of Assembly to and for the use of a certain
   Peter Williams unless the [if The] Said John Hodges by himselfe or
   his attorney Shall appear and answer unto the Said Peter Williams
   in a plea of Trespass upon the Case According to Law and that by
   good and Lawfull men of your Bailiwick you make known unto .
   ye Person or persons in whose hands you make the Same Attachmt
   that he She or they be and appear before the Justices of our Said
   Court to be held as afd to Shew cause if any he She or they have
   why the Same goods Chattells rights or Creditts So attached in his her
   or there hands ought not to be Condemned according to Law if to -
   him her or them it Shall Seem meet and how you Shall Execute this
   writ that you make known unto our Said Justices at the day and place
   afd and have you then and there this writ witness Edward Scott
   Gentn one of the Justices of our Said Court this 26th. day of Novemb.r in
   the Second Year of our Dominion &ca. Anno Domi 1716 —
