119 March Court 1716 on back of the preceeding Indictment was Endorsed as followeth vizt. Billa vera pr me Simon Wilmer foreman Evidences Edward Williams Joseph Welding fild Novemb.r Court 1716 and now at this Court Came the afd John Johnson Clarke of the Indictmts. and the afd John Jones being called came and in his proper person appeared to the afd Indictment~ and prayd that he might have his - tryal on the Same on which Edward Williams an Evidence to the Same being Solemnly called came not and he being the person that could prove the fact and not being at Court the Clarke of the Indictment comes into Court and by Consent of the Court Enters that the afd Indictment be prosecuted no farther and that the Said John Jones go thereof without day and that he pay his fees on the Same and that he be kept in Custody untill the Same be paid Amounting to the Sume of five hundred and forty Eight pounds of Tobacco . on which John Clarke and Roger Hix both of Said County comes into Court and assumes to pay for the afd John Jones the Sume of Tobo he is chargable with on the afd Indictment~ John Jones afd being bound by Recognizance at last Court for his appearance to this Court. The afd John in his proper person appears. to the Same ordered that he be discharged from his Said Recognizance and his Sureties for his appearance . John Jones afd his Recognizance being taken in the Sume of Twenty pounds Sterling to the use of his Lord Ship if in case he did not appear and answer unto a certain indictment for hogg Stealing ag.st him and in the mean time he was to be of good behaviour And at this Court no person Shewing any cause why the afd recognizance Should not be discharged This Court here discharges the Same Recognizance Likewise John Peters and Roger Hix at the Same time afd Entred into Recognizances Each of them in the Sume of tenn pounds Sterling to. the use abovesaid to be Levied as abovesaid Conditionally that if the afd John Jones did not appear and answer as afd and in ye meantime he was to be of good behaviour &ca. This Court here discharges the Same Recognizances each of them Joseph Weilding at the Same time afd Entred into Recognizance in the Sume of Twenty pounds Sterling to the use of his Said Lordship if in case he did not appear at this Court and Prosecute on his Said Lordships behalfe against the afd John Jones on the Indictment afd the afd Jo |
