   109                                 Novembr Court 1716
   Commanded who being called likewise came viz Samuel Thomas John
   Faning Zachariah Mackdaniel Francis Bellows Edward Davis Daniel
   Ferrolo Fredrick Hanson Roger Hailes Samuel Norris Benjamin Blackleadge
   Arthur Foreman Ebenez Blackiston which Jury being duely Elected tryd
   and Sworn and having heard the pleadings Evidences and allegations on
   both Sides do deliver there verdict at the barr . the Plt & Deft apprs to Same
   And the Jury afd Say that they are agreed on a verdict and Say that they
   find the Deft~ not Guilty of the premises imposed against him in manne[r]
   and forme as above Sett forth   And by Samuel Thomas there foreman
   all So Say and the afd Deft by his attry afd prays Judgment on the —
   verdict of the Jurors afd === Therefore it is Considered by the
   Court here viz.t this Twenty fourth day of Novemb.r Anno Domi one —
   Thousand Seven hundred and Sixteen That the afd William Spearman
   take nothing by his writ and Declaration afd but that he and his pledges
   of Prosecuteing be in mercy and that the Said William Frisby go thereof
   without Day and also that the afd William Frisby Recover against the
   Said William Spearman the Sume of five hundred and thirty pounds of~
   Tobacco Cost aboutt his defence Expended According to the forme of the
   Statute &ca. ——
