Novembr. Court 1716 108 that he have then and there the Said writ &ca. Att which Said next Cort vizt. the Twentieth day of Novemb.r the Same year last mentioned the day of return of Said writ came William Ringgold Gent~ one of the Coroners. of this Court and made Return thereof in these words thereon Endorsed as folls viz.t Cepi Corpus pr Willm Ringgold Corr. Kt Coty . . And a Decln. being filed when Said writ Issued forth and a Copy thereof Served therewith according to Act of assembly in Such Cases made was as folls vizt Kent County Maryland Ss William Frisby late of Kent County Gent was attached to answer unto William Spearman of a plea of Trespass on the Case And where: :upon the afd William Spearman ye first day of Novemb.r in the year of our Lord one Thousand Seven hundred & fifteen at the Parish of St. Pauls in the County afd and within the Jurisdiciõn of this Court was possessed of the - goods and Chattells following (viz) one gray horse branded with on the near Shoulder & C on the near buttock of the price of Eight pounds Sterling money of great Brittaine and being So possessed the goods and Chattells afd out of his hands and Possession casually lost which Said goods and Chattells afterwards to witt the Said first day of Novembr afd at the Parish County & Jurisdiciõn to the hands and Possession of the Said William Frisby by finding came Nevertheless the afd William Frisby knowing the goods & Chattells afd to be the Proper goods & Chattells of the Said William Spearman and to the Said Wm Spearman of right to belong & appertain Nevertheless contriving & fraudulently intending the Said Willm Spearman of those goods and Chattells craftilly and Subtilly to deceive and defraud the goods and Chattells afd altho often required to the Said William Spearman hath not delivered but the goods and Chattells afd afterwards to wit the first day of Decemb.r in the year afd at the Parish County and Jurisdiciõn afd to his own proper use converted and disposed to the damage of the Said Wm. Spearman twenty pounds and thereupon he brings Suite &ca. Johson pr Quer pr Deft~ pls &ca. John Doe Richd Roe And now at this Court the Said Deft by Thomas Bowne his attry apprs. to the above accõn and pleads as folls vizt~ And the afd Deft- by Thomas Bowne his attry Comes and defends ye force and Injury when &ca. and Saith that he is not guilty of ye premises above imposed against him and of this he puts himselfe upon the Country TBowne pr Querr- And the Plt in like manner Johnson pr querr Thereupon Command was given to the Sherf of Kent County - that he immediately cause to come here Twelve &ca. By whome &ca. to Recognize &ca. Because as well &ca. Who neither &ca. And the Sherf comes and Saith that he hath ready twelve as by his precept it was Commanded |
