March Court 1714/15 Admitted and Sworn and at ye request of a Certain Richard Draftgate facter of ye Sd Plts. Produces and Exhibitted according to the Custom of~ Merchants the first of the afd three Bills of Exchange the Second or third Bills of ye Same tenor & date not being paid or accepted unto the afd. William Cordins to whom ye Same for payment was directed and demanded payment of ye Contents thereof According to ye tenor & Effect of the Same . Bill which Said William Cordines afterwards at ye time & place Last~. Said Answered that he would not pay ye Said first Bill of Exchange . for want of Effects Whereupon afterwards viz at ye time & place last Said Notary Publick did According to ye use and Custom Amongst Merchants and at ye Request of the afd Richd Draftgate Solemly Protest. against the Said James Crawford drawer of the Said Bills and all others Concerned for all change rechange Costs damages & Intrest Suffered & to be Suffered for want of Payment of the Said Bill as by the Sd first Bill of~ Exchange So as afd Protested with ye Instrument of Protest. in writing in- Common forme under ye hand & Seale of ye Said Notary here in Court brought may appear and the Said Plts further in fact Say that they in ye life time of the Said James viz the twenty Second day of June Anno Domini Seventeen hundred & thirteen at ye Parish of S.t Paul in Kent County afd in ye afsd - Jurisdiciõn of ye afd Protest gave ye Said James Notice And Since ye death of ye Sd James they also the third day of May Anno Domini Seventeen~ hundred & fourteen at ye County & Jurisdicion Last Said gave the Said Deft notice and that neither of ye Sd three Bills was accepted or paid Nevertheless ye Said James in his life time and the Said Deft Since his Death to whom~ Letters of Administracon in due forme of Law have been Committed ye Promise & Assumption of ye Said James So as afd made not minding but Plotting & contriveing ye Same Plts in the Behalfe Craftily to deceive & defraud ye afd tenn pounds & four Shillings Sterling money with the Cost. Damage and Intrest amounting to ye Sum of two pounds & nine pence Sterling money which by ye Laws of this Land & Custome amongst Mercht. |
