At which Said next Court vizt. the first day of March ye Same year last mentioned the day of return of Said writ Came William Frisby Gent high Sherrife of Said County and made return thereof in these words thereon~ endorsed as foll vizt. Cepi Corpus pr Wm Frisby Sherf. and a Declaration being filed when Said writ Issued forth and a Copy thereof Served therewith according to Act of Assembly in Such Case made thereof Served therewith according to Act of Assembly in Such Case made was as foll. vizt. Kent County Maryland Ss Sam.ll Bury late of Kent County in the Province afd Carpenter als Dict~ Samuel Bury of Sd County Carpenter was Sumoned to answer unto Dennis Clarke of Sd County Cordwainer of A Plea that he render unto him the full Sume or just quantity of four hundred & Seaventy pounds of good Sound Merchantable Leafe Tobacco clear of all manner of Trash & Ground leaves in Cask to Containe the Same which from him he unjustly detains And whereupon the Said Dennis Clarke by John Johnson his Attry Saith that whereas the afd Samuel the fourth day of June in the year of our Lord one thousand Seven hundred & Twelve at the Parish of St. Pauls in the County & Province afd & within the Jurisdiciõn of this Court by his Certain bill or writeing obligatory Sealed with the Seale of the afd Samuel here into Court brought whose date is the day & Year afd did Acknowledge himselfe to be holden & bound unto the Said Dennis in the afd Sum or quantity of four hundred &. Seaventy Pounds of good Sound Merchantable leafe Tobacco clean & clear of all manner of Trash & ground Leaves in Cask to containe the Same conveni: :ent in Kent County abovesd when ever afterwards he Should be thereunto . required Yet Nevertheless the afd Samll. altho’ often required &ca. the Said . Sum or q.ty of four hundred & Seaventy pounds of Tobacco as afd to the Said Dennis hath not paid nor for the Same any ways contented but to pay the Same hath altogether deney’d and Still doth deny to the damage of the Said Dennis one thousand pounds of Tobacco and there: :upon he brings his Suite &ca.
