March Court 1714 56 order & well Conditioned unto the Said William or his Assignes at the afd Port & Province of Maryland at or upon the Arival of ye Said Ship in the afd Port & Province of Maryland Nevertheless the afd Edward his Promise and assumption afd & ye duty of his office afd in that behalfe he hath not minded but altho’ ye afd Ship hath Since Safely Arived at the Port & Province of Maryland afd viz.t on the third day of June Anno Domini Seventeen hundred & fourteen and altho’ ye. Said William at the Port & Province of Maryland afd hath hitherto always abided and been redy to receive ye. Same Chest & Merchandizes And to pay the Primage and Avarige [?] Accustomed Yet the Merchandizes following that is to one peice of Kenting of ye Value of ten Shillings & Six pence Sterling money one piece of fine garlix of ye value of one pound & Eleaven Shillings Sterling money Seventeen~ yards of Shalloon of ye price of one pound four Shillings and one peny Sterling . money In ye whole of ye value of three pounds five Shillings & Seven pence Sterling money of ye. afd Chest & Merchandizes Shiped as afd part the Said Edward intending the Sd. William thereof to defraud the Sd Edward ye Said one piece of Kenting one piece of fine Garlix and Seventeen Yards of Shalloone of the afd Value to the afd William hath not delivered altho’ to deliver the Same the Said Edward afterwards viz.t on ye. fourth day of June Anno Domini Seventeen hundred & fourteen at ye Parish of S.t Paul in Kent County afd within ye Judisdiciõn of this Court by the Said William hath been thereunto required but the Said Piece of Kenting one piece of Garlix & - Seventeen Yards of Shalloon unto the Said William to Deliver ye Said Edward hitherto hath denied & Yet denys to the Damage of the Said William tenn pounds Sterling money and thereupon he brings Sute &ca T Bowne pr Quer Plegs &ca. Jno Doe Richd&Roe And the Said Plt. by his Said Attry Prays that the afd Deft. to his afd Decl.n may Answer And the afd Edward in his proper person comes and defends ye force and injury when &ca. And Saith that the afd William his Action afd against him ought not to - have and maintaine because he Saith that he did not Assume to the Said William in manner and form as he the Said William in his Declaration hath Sett forth and declared and of this he puts himselfe upon ye Country and ye Plt. in like manner Ed.
