Answer at next Court which was granted the Same day was Given the Plt~ also Att which Said next Court viz.t the first day of March the Same Yeare last mentioned Came. the Sd Plt. by Thomas Bowne his Attry and the afd Deft. by Andrew Hamilton his Attry. and the Said Plt by his Sd Attry declare as folls vizt. Kent County in Maryland Ss Edward Rottherford late of Kent County afd Mariner Stands Attached to Answer to William Pearce of . a plea of Trespass upon the Case And whereupon the Said William by Thomas Bowne his attorney Complains for that Whereas Robert [Crukshanks] of the City of London Merch.t ye. twenty Sixth day of February Annoq Domini Seventeen hundred and thirteen at London| in parts beyond the Seas at ye Instance of the Said Edward Shipped & leaden on board ye Goode Ship called the Ffactor whereof the afd Edward then under God was Master and then riding at Anchor in the River of Thames at London afd and then bound unto ye Part & Province of Maryland one Chester Containing divers Merchandises that is to Say one peece of Drugett Containing thirty Eighth Yards Seventeen Yards of Shalloon thirty three Ells of brown Ticklon: :berges one peice of kenting Eleaven and a halfe yards of Scoth Cloath one peice of fine Gar: :lix one peice of five Dowlace halfe a pound of fine three Cord Moyhare one Gross of. new fashoned brest Moyhare Buttons one Gross of Coat Mohare Buttons two Skeins of best Belladine [?] Silk one quarter of a pound of best Mardston [?] Cullered thred one pint of oyle of . Turpentine A Small quantity of Oyle of S.t Johns Wort halfe a pint of Spirit of Vitorall [?] one. pound of Venice [illegible] three bottles one pott & box of ye Value of twelve pounds Seventeen Shillings Sterling money In good order & well conditioned upon ye proper Account & Risque of ye afd William to be delivered to ye Sd William by y.e name of Coll. William~ Pearce of Maryland the Dangers of ye Seas only Excepted freight free the Said Willm or his Assignes paying for the Sd Goods the Primage and Average Accustomed And the Sd Edward the afd Chest Containing ye Merchandizes afd in ye. Ship afd and in his Care and Custody for the . reason afd ye. afd day & year Att London afd had & delivered And in Consideration of ye. premises the afd Edward on the afd Twenty Sixth day of Ffebruary Anno Domini Seventeen hundred & thirteen at London in ye Parish of S.t Paul in Kent County afd within ye Jurisdiciõn of this Court upon himselfe Assumed and to the Said William then and there last Said faithfully promised that he the Said Edward the afd Chest & Merchandizes - would in the afd Ship Transport as afd and would deliver the Same in like good order |
