and Twelve hundred pounds of Tobacco & when y.o have ye Same So attached or any part thereof the Same So attached or any part thereof the Same in your Custody Safe keepe So that y.o have them before the Justices of our next County Court to be held at our Court house in the Town of Chester in Said County on the first Tuesday in August next Then & there to be Condemned According to Act of Assembly to and for ye. use of a Certain James Smith unless he the Said S.r Robert Dunckley by himselfe or his attorney. Shall appear and Answ.r unto the Said James Smith in a plea of Trespass upon the Case According to Law and that by good and Lawfull men of your Baylwick you make known unto the Person or Persons in whose hands you make y.e Same Attachment that he She or they be and appear before the Justices of our Said Court to be held as afd to Shew cause if any he She or they have why the Same Goods Chattells Rights or Creditts So Attached in his her or there hands ought not to be Condemned According to Law . if to him her or them it Shall Seem meet And how you Shall Execute this writt that you make known unto our Said Justices at the day & place afd And have you then & there this writt witness William Pearce Gent- chiefe Justice of our Said Court this 4.th day of June in the Thirteenth Year of our Reigne &ca. Annoque Domini 1714 Bowne pr quer Jams Smith Clk . Att Which Said next Court viz this third day of August in ye Year afd the day of Return of Said Writt Came William Frisby Gent- High Sherf of Said County and made return thereof in these . words thereon Endorsed as followeth viz.t Kent County Ss. By vertue of ye within writ to me directed to the Justices within Mentioned I Certifie that I have Attached in y.e hands of a Certain Samuel Thomas. of Said County the Sume of fourty Shillings Sterlg. money as the Rights & Creditts of ye. within mentioned S.r Robert Dunckley to Satisfie to ye. within mentioned James Smith in part of the within Judgment & have also made known unto ye Said Samuel Thomas that he be and appear at the time and place within mentioned to Shew Cause if any he have &ca why ye afd forty Shillings Should not be Condemned According to . Law before Charles Hynson & William Graves good & Lawfull men of my Baylwick &ca. And also I Do ~~ Certifie to ye Same Justices within mentioned that I have Attached in the hands of a Certain Dominick Kenslagh of Said County the Same of Seventeen Shillings Sterling money on ye Rights & Creditts of y.e within mentioned S.r Robert Dunckley to Satisfie to y.e within menconed James Smith in part of y.e afd Judgment and have also made known unto the Said Dominick Kenslagh that he be and appear at ye time and place afd to Shew Cause if any he have &ca. why ye. afd Seventeen Shillings Should not be Condemned According to Law before James Frisby & William Blackiston good & Lawfull men of my Baylwick &ca. as the within writt Exacteth & requireth pr Wm Ffrisby Sher. and now here at the Said Court viz.t the Same day Last mentioned Cometh the afd . James Smith by Thomas Bowne his Attorney and prayeth the Court here that he may have Judgment for Condemnation of the abovesd fourty Shillings Sterl in the hands of Samuel Thomas and Seventeen - Shillings |
