Court house in the Town of Chester in Said County to Answer unto M.r Thomas Christian of a plea that he render. unto him the full and Just Sum of one Thousand two hundred pounds of good Sound Merchtable Lefe Tobaco w.ch from^himbe unjustly detains &ca. And that he have then & there the Said writt &ca. Att which Said next Court viz.t the first day of June Annoque Domini one Thousand Seven hundred and — fourteen the day of return of Said Writt Came James Harris Gentleman high Sherrife of Said County and made . return thereof in these words thereon Endorsed as folls vizt. Non Est Inventus pr JaHarris Sherf. Likewise Command was given to the Sherf of Kent County the fourth day of June in ye thirteenth . year of the Reigne of her now Majestie Anne &ca that he take John Budd of the afd County Planter als. Dics John Budd Planter of Kent County if he Should be found in his Baylwick & him Safe keepe So that he have his body before her Said Majesties Justices of the next Court to be held at the Court house in the Town of Chester in Said County to Answer unto M.r Thomas Christian of a plea that he render unto him- the full and Just Sum of one Thousand two hundred pounds of good Sound Merchtable Lefe Tobacco w.ch — from him he unjustly detains &ca. And that he have then & there the Said Writt &ca. Att which Said next Court vizt. the third day of August in the Yeare Last mentioned the day of. return of Said writt Came William Frisby Gentleman high Sherrife of Said County &made return— thereof in these words thereon Endorsed as folls viz.t Non Est Inventus pr Wm Frisby Shf —— But a Short note being filed when Said writt Issued forth and a Copy thereof Expressing the true Cause of Accõn left at the last Place of the Defendants abode according to act of assembly in Such Case made was as folls vizt Kent County in Maryland Ss Thomas Christian ag.st John Budd. The true Cause of Accõn is that the Said Deft. Stands indebted to ye Said Plt the Sume of one Thousand. two hundred pounds of Tobacco as by his Bill past the 15.th day of October in ye year of our Lord 1713 for ye afd Sume for which ye Said Plt hath not made any Satisfaccon for ye Same for which ye Said Plt - prays that an Attachmt may to him be granted According to Act of Assembly in Such Case made &ca. . fild March ye 19.th 1713. ~~~Bowne pr qr— And now at this Court viz this third day of August Annoque Domini one Thousand Seven hundred and fourteen The afd Plt. not being at Court upon Calling the appearance Dockett over . and the Clarke of the Court informes the Same that there was A non Est Inventus in the . Said Cause before this Court and unto this Court an other non Est Inventus which being two - writ Returnd non Est Inventus And the Attorney for the Plaintife not being at Court to inform them And the Season of the Year for Laying Attachments for Tobacco being So late that~ not withstanding the Attry for the Plaintife not being at Court to pray ye Attachm.t [now?]. this Court being informed by Severall persons that the Effects of the Said Deft in Tobacco that is now hanging and Considering that if it Should be Left unstript to November . the Said Tobacco may Come to nothing . Therefore it is Considered by the Court |
