June Court 1714 Called Came and in his Proper Person appeared to the afd Indictment And prays that Council may be assigned him ordered by the Court here that Mr Francis Cooke one of the attorneys of this Court be Council for the afd Samuel ordered by the Court here that [William] Frisby Sherrife of Said County keepe the Said Samuel Exell in Safe Custody Untill he hath had [his] Tryall on ye afd Indictm.t and the Said Indictment being read to the Said Samuel Pleads not Guilty & for tryall Puts himselfe on the County Exell in proper person and he who follows for our Lady the Queen Says he is Guilty Bowne pr Domi Rega Command was therefore given to the Sherrife of Kent County that he immediately Cause to Come here twelve &ca. By whom &ca. To Recognize &ca. Who neither &ca. Because as well &ca. and the Sherrife of Said County Comes and - Saith that he hath Ready twelve in by his precept it was Commanded And the Juriors being Called Likewise Came vizt Samuel Thomas Philip Davis Samuel Wickes Daniel Tarrilo James Ryly William Simpson Thomas Ringgold John Moll Edward Worrell Samuel Tovey John Green & Mathew Piner which Jury being duely Elected tryd & Sworn and haveing heard the Pleadings Evidences and allegations on both Sides do Depart from the barr and after . Some time do againe Return to the Barr and being Called over as also the . Said Samuel Exell and he also doth apepar and the Jury being asked whether they are agreed on a verdict or not Do Say they are all agreed on a verdict and being Asked whether the Said Samuel Exell was guilty or not guilty as he Stands Indicted Do Say he is guilty as he Stands Indicted and by Samuel Thomas there foreman all So Say and Thomas Bowne Clark of the Indictments Comes and prays Judgment on the verdict afd. Therefore it is Considered by the Court here vizt this fourth day of June Annoque~ Domini one Thousand Seven hundred and fourteen That the Said Samuel Exell Pay the Sume of Twenty pounds Sterling Debt According to Act of Parliament for Committing the offence in the above Indictment And the Same Twenty pounds to be Disposed as followeth vizt one . third part to her Majestie ( vizt the Sume of Six pounds thirteen Shillings & four |
