June Court 1714 to the afd Accõn which was granted and that James Harris Gentn high Sherrife of Said County keepe the Said Deft in Safe Custody untill he Shall give Special baile after which John Faning and Abraham Ambrose both of Said County here in Court Cometh and Acknowledged themselves Joyntly & Severally Special Bayle for the Said Deft and they and either of them did undertake for ye Said Daniel the Paym.t of the Damages & Costs if it Should happen that the Said Barth.o Shall obtaine Judgment against the Said Daniel in the Said Accõn of Trespass upon the Case and the Said Daniel the Condemnation afd Shold not Satisfie nor himselfe to the Custody of the Sherrife of Said County deliver or that the Said John Faning & Abraham Ambrose or either of them the body of the Said Daniel Shall not render &ca and the Sd Deft by Francis Cooke his attry appears to the above Accon~ and prayd liberty thereof to imparle thereto and to Answer at next Court which was Granted the Same day was given the Plt. in like manner and now at this Court vizt this Second day of June Anno Domini one thousand Seven hundred and fourteen The Same Accõn Standing for Tryal Came the Said Plt. by Thomas Bowne his attry and the Said Deft by Francis Cooke his attorney and Pleads as folls vizt. and the Said Deft. by Francis Cooke his attry Comes and Defends the force and Injury when &ca. And for plea Saith that he did not Assume in that manner and form as above alleadged and of this he puts himselfe upon the . Country F Cooke pr Deft and the Plt. in like manner Bowne pr Querr Command was therefore given to the Sherf. of Kent County that he Immediately Cause to Come here twelve &ca. By whome &ca. to Recognize &ca. Who neither &ca. Because as well &ca. And the Sherf Comes and Saith that he hath Ready twelve as by his Precept it was Commanded and being Called Likewise Came vizt Samuel Thomas Philip Davis Mathew Piner Samuel Wickes Daniel Turrilo James Ryley John Hendrickson William Simson Marmaduke Tilden Edward Worrell Samuel Tovey Richard Davis which Jury being duely Elected tryed & Sworn And the said Plt. Comes into Court And takes his Corporall Oath on the holy Evangilists of Almighty God And Saith that the above Account is Just & true as it Stands & |
