   Assumed and to ye Said Plt. then & there last Said faithfully Promise that he the Same
   Deft So much Merchanable Tobacco as he the Said Plt for the Medicinal & Physical Prepa:
  =ratives prepared delivered & Administred as afd & for the afd visits & Services made
   done & performed as afd Should Reasonably deserve unto ye Same Plt when thereunto
   afterwards Required would well & truly pay & Content and the afd Plt in Deed Saith
   that for y.e afd Medicinal & Physical Preparatives prepared delivered & Administred as
   afd and for the afd visits & Servisces made done & performed as afd he Reasonably
   deserved ye Sume of two Thousand nine hundred Twenty & Two pounds of Merchtble
   Tobacco in manner as in ye afd Acco.t is Set forth of which ye Said Deft   then & there
   last Said had notice Notwithstanding ye afd Deft   his Promise and assumpcõn
   afd in forme afd made little minding but Plotting & fraudulently intending him-
   the Said Plt in that Behalfe the afd two Thousand nine hundred twenty two .
   pounds of Tobacco or any part thereof unto the Said Plt the Said Deft hath not-
   paid nor made any Content for the Same altho’ to pay the Same he the Said
   Deft. afterwards that is to Say on the Sixth day of May in ye Year of our Lord Christ~
   Seventeen hundred & thirteen at the Parish of S.t Paul in Kent County afd in ye.
   Jurisdiccõn of this Court by the Said Plt hath been thereunto Required but ye.
   Same to pay or make Content therefore he ye Said Deft hitherto hath denied &
   yet denys to ye Damage of the Said Plt Six Thousand Pounds of Tobacco &.
   thereupon he brings Sute &ca. TBowne pr Querr Plegs &ca Jno Doe & Richd Roe —
