March Court 1715 he cause to come here twelve &ca. By whome &ca. who neither &ca. to recognize &ca. Because as well &ca. And the Sherf comes and makes return that he hath here ready twelve &ca. who being called like :wise came vizt. Thomas Hynson John Greenwood John Underhill~ John Green John Talbott Arthur Foreman William Jones Daniel Cooley Abraham Ambrose John Faning John Williams Thomas Gideon who being duely Elected tryd and Sworn and having heard the Pleadings and the Plt Comes into Court and takes his Corporall Oath on the Holy Evangilists of Almighty God & Saith that he Accot against John Hodges the Deft is Just and true as it Stands Stated for the Sume of Six pounds twelve Shillings and Six pence Currant money of America and haveing heard - the rest of the Evidences and allegations on both Sides do with~ draw to Consider and after Some time do againe return to . the barr and being called over as also the Plt~ and Deft~ do all appear and the Jury being asked whether they are agreed on a verdict or not do Say they are agreed on a verdict and being asked whether they find for the Plt or Deft do Say they find that the Deft did not assume in manner and forme as to - the first assumption above in the Decln and for the Say that the Deft~ as to the Second Assumption in the Decln Set forth did assume in manner and forme as in the Decln declared and find Damages Six pounds twelve Shills and Six pence Currant money of America with Cost thereon accrueing And by Thomas Hynson there foreman all So Say The Deft afd by his attry afd moves in Stay of Judgment on the verdict of~ the Jurors afd which is granted and that Reasons be fild dureing this Court And Afterwards the Said Deft by John~ Roberts |
