March Court 1715 Court Came an ord.r from William Bladen Esq.r Attorney Genrall to John Johnson Clark of the Indictments- of this Court to Enter a Noli prosequi on the Indictment afd mentioned who denys to prosecute the Same And the afd William Darby prays that he may Come to tryal or Some other end may be made of the Same on which this Court orders that Mr. John Roberts one of the attrys of this Court Prosecute the Same Indictm.t ag.st the afd William Darby. . And that he Come to tryal on the Same Immediately the Indictm.t folls vizt Kent County Maryland Ss The Jurors for our Sovereigne Lord the King that now is & the body of Kent County - upon their Oath do prsent that Willm Darby of South Sarsafrax Lower - Hundred in the County afd Labourer on the tenth day of December in the Year of our Lord one Thousand Seven hundred & fourteen at Sarsafrax upper hundred in the County afd & within the Jurisdiciõn of this Court by force and Arms &ca. Sixteen hoggs of the price of Nine hundred & Sixty pounds of Tobo. of the Goods & Chattells of a Certain person— unknowne then and there being found feloniously did Steale take & bear away ag.st the Peace of our Sovereigne Lord the King that now is his Crown & dignity & against the forme of an Act of assemb :ley of this Province in that Case made and Provided Johnson pr Dni Reg: Evidences John Jones James Brower John Heading Samuel Wallis Robt Darby Nichll Ryley — Billa vara pr Edwd Plesto foreman filed Aprill the 8:th 1715 And the Same indictement being Continued from Court to Court untill this Court and now at this Court the afd Will: Being Caled Came and in his proper person appeared to the afd Indictm:t at the barr M.r Thomas Bowne appears as Attry for the afd Will.m And the afd Indictment being Read The afd William pleads not~ Guilty and for tryal puts himselfe on ye Country Darby in p.ria psona— And he who follows for our Said Lord the King in this Case by the Court Specially Appointed Saith he is Guilty Roberts pr Dm:no Rege. Whereupon Command was given to the Sherf of Kent County that he immediately Cause to Come here twelve &ca. by whom &ca. who neithe[r] &ca. to Recognize &ca. because as well &ca. And the Sherf Came and made~. |
