                                      March Court 1715
   bound and obliged himselfe his heires Ex.rs Adm.rs to pay or Cause
   to be paid unto the afd Thomas Smyth the afd Just Sume of five
   hundred and fifty pounds of good Tobo and Caske of the afd value
   of forty five Shillings and tenn pence Sterlg money at or upon the
   tenth day of November next ensueing ye date of the Said writing
   obligatory Yet the afd Thomas Joce altho’ often required ye afd
   five hundred and fifty pounds of Tobo unto the Said Thomas Smyth
   hath not rendered nor paid nor Caused to be rendered or paid but the
   Same to render or pay the Said Thomas Joce hitherto hath denied
   and Yet denys & unjustly detains to ye damage of the Said Thomas
   Smyth four pounds tenn Shills Sterlg money and thereupon he
   brings Suite &ca. TBowne pr Querr pls &ca. Jno Doe & Rd Roe~
   And the Sd Deft being Called Came and the Said Plt by his afd
   attorney prays that the Sd Deft may give Sp.l bayle to the afd accõn which
   is granted and that he be kept in Safe Custody untill he Shall give Sp.l
   bayle to the afd accõn . . After which Comes into Court Ebenezer —
   Blackiston of Said County and acknowledges himselfe Special bayle
   in the afd accõn and doth undertake for the Said Thomas Joce the
   payment of the Debt afd and Cost thereon accrueing if it Should hap:
  :pen that the Said Plt Should obtaine Judgment against the Said
   Deft~. in the Said Accõn of Debt and the Said Deft~. the Condemna:
  :tion afd Shall not Satisfie nor himselfe to the Custody of the Sherf of
   Said County deliver or that the Said Ebenez.r the body of the Said -
   Thomas Shall not render &ca. . and the Said Thomas Came into
   Court and in his proper person appeared to the above accõn and
   Saith that he cannot gainsay the accon afd of him the Said Plt nor
   but that the writing obligatory above mentioned is his Act &
   deed and that he oweth unto the afd Plt the Sume afd and is
   willing that Judgment Should be entred for the Same and Cost~
   thereon accrueing Therefore it is Considered by the Court~
   here viz this twenty Second day of March Anno Domini one .
