                                         March Court 1715
   Sume of two Thousand three hundred & twenty two pounds of Merchantable
   Tobacco as in the last Said Account Shewn of which the Said Deft then &
   there last Said by the Said Plt notice And that whereas also ye afd Deft
   afterwards viz the afd fifteenth day of August in ye year afd in ye County &
   juridiciõn afd In Consideration that the afd Plt. at ye like Special In:
  :stance & request of ye Same Deft had then & there last Said paid to —
   divers Severall Persons Severall Sums of Tobacco to & for ye use & behoofe
   of ye Said Deft in the whole amounting to ye Sume of two hundred and
   fifty pounds of Tobacco in ye last mentioned Account~ perticularly Shewn~
   upon himselfe Assumed & to the Said Plt then and there last Said faithfully
   promised that he ye Said Deft ye Said two hundred & fifty pounds of Tobacco
   to the Said Plt when thereto required would well & truly pay & Content
   Nevertheless ye afd Deft~ his Severall promises and Assumptions afd in
   forme afd made as to ye afd Severall Sums of Tobacco in ye whole amount:
  :ing to four thousand eight hundred ninety & four pounds of Tobacco paid[?]
   he hath not minded nor kept but altho’ ye Said Deft~ hath paid to him
   ye Said Plt~. Seven hundred & ninety pounds of Tobacco of ye afd four Thousand
   eight hundred ninety & four pounds of Tobacco Part Yet ye afd Deft his
   [P]romise and assumption afd as to ye Sum of four Thousand one hundred .
   & four pounds of Tobacco of ye afd four Thousand eight hundred ninety &
   four pounds of Tobacco residue litle regarding but ploting & designing to
   defraud ye Said Plt. in that behalfe the afd four thousand one hundred &
   four pounds of Tobacco to the Said Plt altho’ afterwards viz on ye Seventh
   day of 7ber.. Anno Domini Seventeen hundred & fifteen he was at Kent Coty
   afd within ye Jurisdiciõn of this Court thereto required hath not paid nor made
   Content therefore but the Same to him to pay or Content ye Said Deft~
   hitherto hath denied & yet denys to ye damage of the Said Plt~ Eight Thou
   sand pounds of Tobacco & thereupon he brings Sute &ca. TBowne pr
