   Said next Court vizt. the Twentieth day of March ye Same year last mentioned -
   the day of return of Said writ Came William Frisby Gent high Sherf of Said —
   County and made Return thereof in these words thereon Endorsed as folls vizt. Cepi
   Corpus pr Wm Ffrisby Shef. . And a Decln being fild when Said writ Issued
   forth and a Copy thereof Served therewith according to Act of Assembly in
   Such Case made which is as folls vizt Kent County Ss Samuel Slite of Kent~
   County Planter was attaiched to Answer unto Samuel Philips of a plea of .
   Trespass upon ye Case And Whereupon the Said Plt by Thomas Bowne
   his Attry Complains for that whereas ye afd Deft ye fifteenth day of Augst.
   Anno Domini Seventeen hundred & fifteen at Kent County afd within
   ye Jurisdicõn of this Court in Consideration that the Said Plt at ye Special
   Instance and request of the Said Deft had then and there Sold & delivered
   to the afd Deft~ for his the Said Defts use divers goods and Merchandizes
   in an account hereto annexed Shewn for the Sum of Two Thousand —
   three hundred and Twenty two pounds of Merchantable Tobacco upon him:
  :selfe Assumed & to ye Said Plt. then and there faithfully promised that he
   ye Said Deft~ ye afd Sum of two Thousand three hundred & twenty pounds of
   Tobacco unot the Said Plt when thereunto required would well & truly pay
   & Content And that Whereas also ye afd Deft~ afterwards vizt. the afd [fif:]
  :teenth day of August in the year afd at the County and Jurisdiciõn afd In
   Consideration that the Same Plt at the like Special Instance and request
   of the Said Deft had then and there last Said Sold & delivered to the Said
   Deft for the use of the Said Deft~ divers goods wares & Merchandizes in~
   an Account thereof hereto annexed Specifically Shewn upon himselfe —
   assumed & to the Said Plt. then and there last Said faithfully promised .
   that he the Said Deft~ So much Merchantable Tobacco as ye last Said goods
   & wares & Merchandizes Sold & delivered as afd at ye time of the Sale & delivry
   thereof Should be reasonably worth and at reasonable rates & values amounted
   to unto ye Said Plt when thereto afterwards required would well & truly
   pay & Content And the afd Deft in deed Saith that ye last Said goods wares
   & Merchandizes Sold & delivered afd at ye time of ye Sale & delivery thereof
   where reasonably worth & at reasonable rates & values amounted to ye
