June Court 1714 to ye Tenour of ye Said Bill unto ye Said James Smith hath not paid nor Caused to be paid but ye Same to pay or render unto ye Said James Smith hitherto hath refused and yet doth refuse and unjustly detains to ye Damage of the Said James Smith- thirty Shillings Sterling mony & thereupon he brings Suite &ca. and brings into Court ye Bill obligatory afd which Testifies &ca. ye Date of which is ye Same day & year afd -Cooke pr Querr Plegs &ca. John Doe Richard Roe . and now at this Court Came the Said Plt. by Francis Cooke his attorney and the Said Deft- being Called Came And ye Sd Plt by his afd attorney prays that the Said Deft. may give Special Bayle to ye above Accõn which is granted and that William~ Frisby Gentn high Sherrife of Said County keepe ye Said Christopher in Safe - Custody untill he Shall give Special Bayle as afd After which William Glanvill and Simon Wilmer both of Said County here . in Court Cometh and Joyntly and Severally they and Each of them do Acknowledges themselves Special Bayle to the above Accon & they and either of them do undertake for the Said Christopher Bateman ye Payment of the Debt & Costs if it Shall happen that the Said James Smith Shall obtaine Judgment against the Said Christopher Bateman in the Said Accõn of Debt and the Said Christopher. Bateman of Condemnation Shall not Satisfie nor himselfe to the Custody of the Sherrife of Said County Deliver or that the Said William Glanvill & Simon Wilmer or either of them the body of the Said Christopher Shall not render &ca. and the Said Deft By Thomas Bowne his attry appears to the above Accõn. After which the Said Deft Comes into Court and Saith that he. Cannot gainsay the Accõn afd of him the Said James Smith nor but that the writing obligatory above mentioned in his Act & Deed and that he oweth unto ye Sd Plt. the afd Sume of one Thousand and two pounds of Tobacco and is willing that Judgment Should be Entred for ye Same and Cost thereon Accrueing So that Execution thereof Cease untill the tenth day of Novenber next Ensueing to - which the Plaintife Consents . Therefore it is Considered by the Court here vizt this Second Day of June Annoque Domini one Thousand Seven hundred and fourteen That the Said Plaintife James Smith Recover against the |
