5-310. CAPITAL PROGRAM.

THE DEPARTMENT OF STATE PLANNING SHALL PREPARE THE CAPITAL
PROGRAM FOR THE STATE.

5-311. 5-310. EXCESS REAL PROPERTY.

(A)  IN GENERAL.

EACH UNIT OF THE STATE GOVERNMENT SHALL NOTIFY THE
DEPARTMENT OF:

(1). ANY REAL PROPERTY THAT IS IN EXCESS OF THE NEEDS
OF THE UNIT; OR

(2) ANY SUBSTANTIAL CHANGE TO ANY REAL PROPERTY OWNED
BY THE STATE.

(B)  DISPOSITION.

FOR ANY REAL PROPERTY IDENTIFIED UNDER SUBSECTION (A) OF
THIS SECTION, THE DEPARTMENT SHALL:

(1)  STUDY THE PROPER DISPOSITION OF THE PROPERTY;

(2)  DETERMINE WHETHER ANY LOCAL GOVERNMENT OR UNIT OF
THE STATE GOVERNMENT IS INTERESTED IN THE PROPERTY; AND

(3)  MAKE AN APPROPRIATE RECOMMENDATION TO THE USING
UNIT OF THE STATE GOVERNMENT AND TO THE BOARD OF PUBLIC WORKS.

REVISOR'S NOTE: This section formerly appeared as Art. 88C,
§ 12.

The references to a "unit of the State government" are
substituted for the former references to State
agencies, for consistency with language used elsewhere
in this article.

The only other changes are in style.

The Commission to Revise the Annotated Code points out
to the General Assembly that the duty of a unit of the
State government to notify the Department under
subsection (a) of this section is not literally
limited to property in the possession of the unit.
The General Assembly may wish to add language
expressing such a limitation.
