In subsection (b)(1) of this section, the words
"special fund appropriation" are substituted for the
former word "revenue", for clarity.
In subsection (b)(3) of this section, the phrase
"federal law" is substituted for the more restrictive,
former phrase "federal regulations", for clarity.
The Commission to Revise the Annotated Code calls the
attention of the General Assembly to the revision of
the second sentence of former Art. 41, § 133(c) in
this section. Although that sentence, which was
enacted as part of Ch. 536, Acts of 1984, seemingly
repealed this section by implication and clearly
conflicted with former Art. 41, § 236(a), which
required that the proceeds from the disposition of
surplus property be deposited in certain accounts
depending on the type of moneys used to purchase the
property, the Commission to Revise the Annotated Code
believes that the General Assembly did not intend to
repeal any provision of this subtitle. Language
substantially identical to that in the second sentence
of former Art. 41, § 133(c) appeared in former Art.
41, § 135(7), which was repealed by Ch. 536, Acts of
1984, and the purpose of the second sentence of former
Art. 41, § 133(c) seems to have been merely to carry
forward the effect of former Art. 41, § 135(7), which
was enacted before the inconsistent provisions of
former Art. 41, § 236(a).

(A) DISTRIBUTION OF EXCESS PROPERTY LIST.
THE DEPARTMENT SHALL DISTRIBUTE PERIODICALLY A LIST OF
EXCESS PERSONAL PROPERTY TO EACH UNIT OF THE STATE OR A LOCAL
GOVERNMENT.
REVISOR'S NOTE: This subsection formerly appeared as Art.
41, § 239.
The phrase "each unit of the State or a local
government" is substituted for the former phrase "all
State and local governmental agencies", to conform to
similar provisions elsewhere in this title.
The former phrase "which may be obtained by the
agencies" is deleted as redundant because all excess
property can be obtained by the agencies.
The only other changes are in style.
