(B)  REGULATIONS.

THE DEPARTMENT SHALL ADOPT REGULATIONS TO IMPLEMENT THIS
SUBTITLE. ANY REGULATION ADOPTED UNDER THIS SUBTITLE IS SUBJECT
TO APPROVAL BY THE BOARD OF PUBLIC WORKS.

REVISOR'S NOTE: This subsection formerly appeared as Art.
41, § 240.

The phrase "adopted under this subtitle" is added for
clarity.

As to the deletion of the word "rules", see the
General Revisor's Note to this article.

The only other changes are in style.

(C)  USE OF EXCESS PERSONAL PROPERTY.

THE DEPARTMENT MAY USE EXCESS PERSONAL PROPERTY TO SATISFY A
PURCHASE REQUISITION IF THE EXCESS PERSONAL PROPERTY:

(1)  IS FUNCTIONAL;

(2)  IS SERVICEABLE; AND

(3)  SATISFIES THE NEED OF THE REQUISITIONING UNIT.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Art. 41, § 238.

In item (3) of this subsection, the word "unit" is
substituted for the former word "agency" to conform to
similar provisions elsewhere in this title.

'4-507. PROCEEDS FROM TRADE-IN.

IF THE DEPARTMENT TRADES IN SURPLUS PERSONAL PROPERTY FOR A
REPLACEMENT FOR THE UNIT OF THE STATE GOVERNMENT THAT DECLARED
THE ITEM EXCESS, THE DEPARTMENT SHALL GIVE CREDIT TO THAT UNIT IN
THE FORM OF A REDUCED COST FOR THE REPLACEMENT PROPERTY.
