3-404. REVIEW AND APPROVAL OF CHANGES.
A UNIT OF THE EXECUTIVE BRANCH OF THE STATE GOVERNMENT MAY
NOT MAKE ANY CHANGE RELATING TO INFORMATION PROCESSING UNTIL THE
CHANGE IS REVIEWED AND APPROVED BY THE SECRETARY FOR
COMPATABILITY WITH EXISTING INFORMATION PROCESSING MASTER PLANS
AND CURRENT PROCEDURES AND EQUIPMENT.
REVISOR'S NOTE: This section is new language derived
without substantive change from the third sentence of
former Art. 15A, § 23B(a).
The words "unit of the Executive Branch of the State
government" are substituted for the former words
"department or agency", to clarify that the authority
of the Secretary does not extend to the Legislative
Branch or the Judicial Branch. See 61 Op. Att'y Gen.
241 (1976).

3-405. PROCUREMENT OF EQUIPMENT AND SERVICES.
(A) APPROVAL OF SECRETARY REQUIRED.
A UNIT OF THE EXECUTIVE BRANCH OF THE STATE GOVERNMENT MAY
NOT PURCHASE, LEASE, OR RENT MECHANICAL OR ELECTRONIC INFORMATION
PROCESSING EQUIPMENT OR ASSOCIATED SERVICES UNTIL THE PURCHASE,
LEASE, OR RENTAL IS REVIEWED AND APPROVED BY THE SECRETARY.
(B) DELEGATION BY SECRETARY.
THE SECRETARY MAY DELEGATE THE POWER TO REVIEW AND APPROVE
THE PURCHASE, LEASE, OR RENTAL OF INFORMATION PROCESSING
EQUIPMENT OR ASSOCIATED SERVICES TO THE HEAD OF A UNIT OF THE
EXECUTIVE BRANCH OF THE STATE GOVERNMENT IF:
(1) THE UNIT HAS AN INFORMATION PROCESSING MASTER
PLAN APPROVED BY THE SECRETARY; AND
(2) THE PURCHASE, LEASE, OR RENTAL IS CONSISTENT WITH
THAT PLAN.
REVISOR'S NOTE: This section is new language derived
without substantive change from the fourth and fifth
sentences of former Art. 15A, § 23B(a).
Throughout this section, the words "unit of the
Executive Branch of the State government" are
substituted for the former words "State departments
and agencies" and "other State agency", to clarify
that the authority of the Secretary does not extend to
the Legislative Branch or the Judicial Branch. See 61
Op. Att'y Gen. 241 (1976).
