3278                                          LAWS OF MARYLAND                                     Ch. 715

15-201.

(A)  THE PUBLIC SHALL HAVE AN EASEMENT OR RIGHT-OF-WAY OVER
ANY ROADS OR WAYS IN CALVERT COUNTY LEADING TO ANY OF THE
FOLLOWING WHARVES OR LANDINGS: LYONS CREEK, FERRY LANDING, LOWER
MARLBORO, HOLLAND CLIFF, DEEP LANDING, LEITCH'S WHARF, HOLLAND
POINT, DUKE'S WHARF, WILLIAMS' WHARF, PARKER'S WHARF, MACKALL'S
WHARF, SOLLERS' WHARF, SOLOMONS WHARF, GOVERNORS RUN, DARES
BEACH, AND PLUM POINT.

(B)  THE PURPOSE OF THIS EASEMENT OR RIGHT-OF-WAY IS SOLELY
FOR ACCESS TO THE WHARVES AND LANDINGS AND ENJOYMENT OF THE
WHARVES AND LANDINGS BY THE PUBLIC.

(C)  THE COUNTY COMMISSIONERS MAY NOT ALLOW THOSE ROADS TO
BE CLOSED UNTIL AFTER A PUBLIC HEARING WITH DUE NOTICE IN ONE OR
MORE NEWSPAPERS IN THE COUNTY.

SUBTITLE 3. LOITERING.

15-301. DEFINITIONS.

(A)  IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(B)  "LOITER" MEANS TO IDLE, STAND, REMAIN, GATHER, OR BE A
MEMBER OF A GROUP OR CROWD OF PEOPLE WHO ARE GATHERED TOGETHER ON
ANY COMMERCIAL PREMISES WITHOUT CONDUCTING ANY LAWFUL BUSINESS
WITH THE OWNER OR OPERATOR THEREOF, OR HAVING PATRONIZED THOSE
BUSINESS ESTABLISHMENTS, TO REMAIN ON SUCH PREMISES HAVING BEEN
DIRECTED TO LEAVE BY THE OWNER, OPERATOR, OR AN AUTHORIZED AGENT.

(C)  "COMMERCIAL PREMISES" MEANS ANY BUSINESS PREMISES
OPERATED FOR PROFIT OR TO WHICH THE GENERAL PUBLIC IS INVITED OR
PERMITTED, INCLUDING PARKING LOTS ADJACENT TO OR CONNECTED WITH
THOSE PREMISES AND SIDEWALKS USED BY THE GENERAL PUBLIC IN
GAINING ACCESS TO THOSE PREMISES.

15-302. UNLAWFUL CONDUCT.

(A)  A PERSON MAY NOT LOITER ON OR ABOUT ANY COMMERCIAL
PREMISES DURING ORDINARY BUSINESS HOURS AFTER HAVING BEEN
REQUESTED TO LEAVE BY THE OWNER, OPERATOR, OR AN AUTHORIZED AGENT
OF THE OWNER AND AFTER HAVING BEEN REQUESTED TO LEAVE BY A POLICE
OFFICER.

(B)  A PERSON MAY NOT LOITER, WITHOUT THE CONSENT OF THE
OWNER, OPERATOR, OR AUTHORIZED AGENT ON ANY COMMERCIAL PREMISES
AFTER THOSE PREMISES HAVE BEEN CLOSED FOR BUSINESS PURPOSES, AND
AFTER HAVING BEEN REQUESTED TO LEAVE BY A POLICE OFFICER.

(C)  A PERSON OR GROUP OF PERSONS MAY NOT ASSEMBLE ON A
PUBLIC SIDEWALK IN CALVERT COUNTY AND CONDUCT THEMSELVES IN SUCH
A MANNER AS TO UNNECESSARILY INTERFERE WITH THE USE OF THE
SIDEWALK AS A THOROUGHFARE BY THE GENERAL PUBLIC.
