revenues in those accounts, then the funds in the Transportation
Revenue Stabilization Account shall be distributed in the manner
provided for the allocation and distribution of highway user
revenues in the Gasoline and Motor Vehicle Revenue Account.
(d) (1) After meeting its debt service requirements, the
Department may use the funds in the Transportation Trust Fund for
any lawful purpose related to the exercise of its rights, powers,
duties, and obligations.
(2) Expenditures under this subsection shall be made
in accordance with any appropriation provided for in any
applicable budget bill or supplementary appropriation bill.
However, an appropriation proposed to be made to any unit in the
Department or proposed to be made for any designated
transportation activity, function, or undertaking that has been
reduced by the General Assembly may not be restored, for the same
purpose as originally proposed, except in an emergency, by the
budget amendment procedure of Article 15A, § 8(e) of the Code, or
otherwise if the General Assembly in striking or reducing the
appropriation, prohibited its restoration. However, except for
emergency capital projects, if the General Assembly explicitly
reduces in the budget bill an appropriation proposed for a major
capital project as defined in § 2-103.1(a)(3) of the
Transportation Article, the appropriation may not be restored for
the same purpose as originally proposed by the budget amendment
procedure of Article 15A, § 8(e) of the Code or otherwise unless
the General Assembly, in striking or reducing the appropriation,
expressly authorized its restoration.
(3) (i) For fiscal years 1983 and 1984 the Department
of Transportation shall utilize the additional funds credited to
the Transportation Trust Fund under Section 8-402(c) of this
article from the proceeds of the tax imposed by Article 56,
[Section 136(i) and (j)] § 136 (D) AND (E) of the Code for the
following purposes in the priority listed:
1. The maintenance, repair,
rehabilitation, and reconstruction of the existing State highway
system, including bridges;
2. The design and engineering and
construction or reconstruction of interstate highways, including
bridges, in order that the State may receive the maximum amount
of federal funds allocated for interstate highway projects; and
3. The design and engineering and the
construction or reconstruction of State highways, including
bridges, due to the structural condition of the highways or
bridges or to the volume of the traffic.
(ii) For fiscal year 1983, the new revenues
derived under Article 56, [§ 136(i)] § 136 (D) of the Code and
allocated or appropriated to the State Highway Administration
shall be in addition to the funds appropriated to the State
