AN ACT concerning

State Use Industries - Personnel

FOR the purpose of providing that certain State Use. Industries
positions are not part of the classified service; providing
for the. development of a certain incentive based
compensation plan; and generally relating to employees of
State Use Industries.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

681J.

(A)  The General Manager of State Use Industries shall have
the authority to determine the personnel needs and requirements
of State Use Industries programs and product and service
industries, and shall have the appointing authority to hire all
subordinate personnel.

(B)  SUPERVISORY AND SALES POSITIONS IN STATE USE INDUSTRIES
SHALL NOT BE PART OF THE CLASSIFIED SERVICE UNDER ARTICLE 64A OF
THIS CODE.

The budget for State Use Industries shall be included in the
budget of the Department of Public Safety and Correctional
Services, and shall be subject to normal legislative review and
approval. The number of its positions shall be included within
the total manpower allocations provided for the Department of
Public Safety and Correctional Services. Furthermore, its
positions shall be subject to the State's Merit System, with the
exception of the General Manager or any other position determined
by the Secretary of Personnel[, who] OR AS OTHERWISE PROVIDED BY
LAW. THE GENERAL MANAGER shall be appointed by the Secretary of
the Department, with the approval of the State Use Industries
Advisory Committee.
