Child or Spousal Support - Earnings Withholding
FOR the purpose of repealing certain provisions of law providing
that if an obligor is in arrears in child or spousal support
payments for more than 30 days the recipient of child or
spousal support or the support enforcement agency may file a
petition for a lien on the earnings of the obligor, and the
court may order a lien under specific circumstances;
providing that under certain circumstances certain court
orders constitute an immediate and continuing withholding
order on the earnings of an individual obligated to pay
child or spousal support; requiring certain support orders
or modification of support orders to contain certain
statements; providing that the earnings withholding shall be
of a certain amount; providing that the court may not serve
a copy of the earnings withholding order on an employer
until the happening of certain events; providing for the
filing and contents of a certain motion; providing certain
fines upon conviction of penalties for certain offenses;
providing for the service and effect of certain court orders
on certain employers; providing for the contents of certain
withholding orders; providing for the priority of an
earnings withholding order over certain other liens or legal
processes; providing for certain duties of employers;
providing provisions against reprisals and dismissals of
employees; imposing certain liability on employers who
violate certain provisions of this Act; providing certain
procedures if the employment of an obligor terminates;
providing certain change of address procedures; providing
certain procedures for an obligor to contest the issuance of
an earnings withholding order; providing for the termination
of certain earnings withholding orders; providing certain
procedures for the enforcement of out-of-state support
orders; providing certain procedures for the enforcement of
support orders if the obligor or employer of the obligor is
located outside of this State; and generally relating to
child and spousal support and withholding of earnings.
