Ch. 329

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Family Law

[Part III. Lien on Earnings for Arrearage]

[10-120.

(a)  If an obligor is in arrears in child or spousal support
payments for more than 30 days, the recipient or the support
enforcement agency may file a petition for a lien on the earnings
of the obligor.

(b)  The petition:

(1)  shall be under oath and include enough
information to enable the court to issue a show cause order; and

(2)  may be filed on a form prepared by the court.]
[10-121.

(a)  On receipt of a petition, the court shall issue a show
cause order.

(b)  The show cause order shall state:

(1)  that a lien on the earnings of the obligor has
been requested;

(2)  the amount of the arrearage;

(3)  the date of the court hearing;

(4)  the date by which the show cause order must be
served on the obligor so that the court hearing may proceed;

(5)  that the court intends to order a lien if the
obligor does not appear at the hearing; and

(6)  that a copy of the order for the requested lien
is attached to the show cause order.]

[10-122.

(a)  The court may not order a lien under this section
unless the court finds that the obligor was more than 30 days in
arrears on the date of service of the show cause order.

(b)  The court shall order a lien on an obligor's earnings,
