SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Agriculture

5-207.

(a)  Each custom applicator, pest control consultant, pest
control applicator, and public agency applicator shall obtain an
annual certificate indicating competence in one or more
established categories from the Secretary. Each private
applicator shall obtain a certificate which shall require
periodic renewal as determined by the Secretary.

(b)  Each application for a certificate by a pest control
consultant, pest control applicator, and custom applicator shall
be accompanied by a $50 certificate fee plus $25 for each
category in excess of one. Each application for a private
applicator's certificate shall be accompanied by a fee to be set
by the Secretary, but not to exceed $7.

(c)  Each applicant for a pest control consultant
certificate, pest control applicator certificate, or custom
applicator certificate shall demonstrate his competence to use
and apply pesticides safely in the State by passing a written
examination prepared and administered by the Department; there
shall be no charge for an initial examination, provided that pest
control applicators, pest control consultants and custom
applicators shall pay $10 for each category of examination after
the initial examination. Private applicators shall pass an
examination or satisfactorily complete a training program
approved by the Department.

(D) EACH APPLICANT FOR A PEST CONTROL CONSULTANT

CERTIFICATE, PEST CONTROL APPLICATOR CERTIFICATE, OR CUSTOM
APPLICATOR CERTIFICATE SHALL HAVE AN ANNUAL PHYSICAL EXAMINATION
BY A LICENSED PHYSICIAN AS A CONDITION OF OBTAINING THE ANNUAL
CERTIFICATE OF COMPETENCE PROVIDED FOR IN SUBSECTION (A) OF THIS
SECTION.

[(d)] (E) Each certificate shall be renewed upon payment of
the certificate fee, [and] demonstration of satisfactory

knowledge of pesticide use, AND CERTIFICATION OF PHYSICAL

EXAMINATION FROM A LICENSED PHYSICIAN.

[(e)] (F) Every place of business engaged in custom
application, pest control application, and pest control
