In the introductory clause of subsection (a) of this
section, the word "providing" is substituted for the
former word "placement", to encompass the reference to
self-insurance.

In subsection (b)(1) of this section, the former
reference to establishment of the Fund for "the
purpose of a program of insurance" is deleted as
unnecessary in light of subsection (b)(3) of this
section.

In subsection (b)(2)(iii) of this section, the
reference to a premium "that a unit ... pays" is
substituted for the former reference to "assessed by
the Treasurer", to reflect that mere assessment is not
sufficient. As to assessments, see § 9-106 of this
title.

In subsection (b)(2)(iv) of this section, the former
reference to "insurance companies" is deleted as
surplusage.

9-104. GENERAL POWERS AND DUTIES OF TREASURER.

(A)  GENERAL RESPONSIBILITIES.

(1)  SUBJECT TO ANY LIMITATION IN AN AGREEMENT OR LAW,
THE TREASURER IS RESPONSIBLE FOR THE PROGRAM.

(2)  THE TREASURER SHALL ADMINISTER THE FUND.

(3)  NOTWITHSTANDING ANY LAW THAT AUTHORIZES A UNIT OF
THE STATE GOVERNMENT TO BUY INSURANCE, THE TREASURER MAY:

(I)  BUY THE INSURANCE IN ACCORDANCE WITH
DIVISION II OF THIS ARTICLE; OR

(II)  REQUIRE THE UNIT TO OBTAIN APPROVAL BEFORE
THE UNIT BUYS THE INSURANCE.

(B)  REGULATIONS.

THE TREASURER SHALL ADOPT NECESSARY REGULATIONS:

(1)  TO SET POLICIES AND PROCEDURES FOR PAYMENT ON
LOSSES, INCLUDING ADJUSTMENT AND APPROVAL;

(2)  TO COLLECT FROM PRIVATE INSURERS ON LOSSES; AND

(3)  OTHERWISE TO CARRY OUT THE DUTIES OF THE
TREASURER UNDER THIS TITLE.
