(C) ASSISTANCE.

THE OFFICE OF THE ATTORNEY GENERAL, THE DEPARTMENT OF
GENERAL SERVICES, AND THE STATE FIRE MARSHAL SHALL COOPERATE WITH
AND ASSIST THE TREASURER IN CARRYING OUT THE DUTIES OF THE
TREASURER UNDER THIS TITLE.

REVISOR'S NOTE: This section is new language derived

without substantive change from former Art. 95, § 27A,

§ 34, § 26(b) and the first and second clauses of (a),

the second clause of § 28, and the first sentence of §

33.

In subsection (a)(3) of this section, the former word
"specifically" is deleted to clarify that the powers
of the Treasurer exist whether another law expressly
or impliedly enables a unit to purchase insurance.

Subsection (b)(1) of this section is revised to
clarify that adjustment and approval are aspects of
"payment".

As to a report on the Program and Fund, see §
2-104(b)(2)(iii) of this article.

9-105. FORMS OF INSURANCE.

(A) SELF-INSURANCE.

(1)  THE TREASURER SHALL PROVIDE SELF-INSURANCE FOR:

(I)  LOSS OF OR DAMAGE TO STATE MOTOR VEHICLES;

(II)  LOSS OF OR DAMAGE TO HULLS OF STATE
VESSELS;

(III)  LOSS OF OR DAMAGE TO STATE REAL PROPERTY,
TO THE EXTENT THAT PURCHASED INSURANCE DOES NOT COVER THE LOSS OR
DAMAGE; AND

(IV)  LOSS AS A RESULT OF A SETTLEMENT OR
JUDGMENT AGAINST STATE PERSONNEL, TO THE EXTENT THAT THE BOARD OF
PUBLIC WORKS PAYS THE LOSS UNDER TITLE 12, SUBTITLE 4 OF THE
STATE GOVERNMENT ARTICLE.

(2)  THE TREASURER MAY PROVIDE SELF-INSURANCE FOR LOSS
OF OR DAMAGE TO STATE PERSONAL PROPERTY, INCLUDING FINE ARTS.
HOWEVER, FOR ANY FINE ART ITEM THAT THE TREASURER DETERMINES IS
IRREPLACEABLE, THE INDEMNITY SHALL BE ONLY FOR REPAIR OF DAMAGE.
