Article 29 - Washington Suburban Sanitary District
Section 3-102(d)
Annotated Code of Maryland
(1983 Replacement Volume)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 3-102(d) of Article 29 - Washington
Suburban Sanitary District of the Annotated Code of Maryland be
renumbered to be Section(s) 3-102(e).

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

Article 29 - Washington Suburban Sanitary District

3-102.

(D) (1)(I) IN THIS SUBSECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(II) "MINORITY BUSINESS ENTERPRISE" MEANS ANY
LEGAL ENTITY, OTHER THAN A JOINT VENTURE, ORGANIZED TO ENGAGE IN
COMMERCIAL TRANSACTIONS WHICH IS AT LEAST 51 PERCENT OWNED AND
CONTROLLED BY ONE OR MORE MINORITY PERSONS.

(III) "MINORITY PERSON" MEANS A MEMBER OF A
SOCIALLY OR ECONOMICALLY DISADVANTAGED MINORITY GROUP, INCLUDING
BLACKS NOT OF HISPANIC ORIGIN, HISPANICS, AMERICAN INDIANS,
ALASKAN NATIVES, ASIANS, AND PACIFIC ISLANDERS, WOMEN, AND THE
PHYSICALLY OR MENTALLY DISABLED.

(2) BY RESOLUTION AND IMPLEMENTING REGULATIONS, THE
WSSC MAY ESTABLISH A MANDATORY MINORITY BUSINESS UTILIZATION
PROGRAM TO FACILITATE THE PARTICIPATION OF RESPONSIBLE MINORITY

BUSINESS ENTERPRISES IN CONTRACTS AWARDED BY THE WSSC IN

ACCORDANCE WITH COMPETITIVE BIDDING PROCEDURES.

SECTION 3. AND BE IT FURTHER ENACTED, That if any provision
of this Act, including any class provided for under Section

3-102(d)(1), or the application thereof for any person or

circumstance is held invalid for any reason, the invalidity shall
not affect the other provisions or any other application of this
Act which can be given effect without the invalid provisions or
application, and to this end all the provisions of this Act are
declared to be severable.

(D) (1) IN THIS SUBSECTION "MINORITY BUSINESS ENTERPRISE"
MEANS A MINORITY BUSINESS ENTERPRISE AS DEFINED IN ARTICLE 21,
SECTION 8-601 OF THE CODE.
