(3) All fees collected for the issuance of new Class
E drivers' licenses under § 16-111.1(a) of this article.
(C) (1) ALL REVENUE COLLECTED ANNUALLY UNDER THIS SECTION
AND APPLIED TO THE MOTORCYCLE SAFETY PROGRAM ACCOUNT OF THE
TRANSPORTATION TRUST FUND SHALL BE USED SOLELY FOR PROGRAMS
ORIENTED TOWARD MOTORCYCLE SAFETY.
(2) ANY SUCH UNUSED FUNDS SHALL BE RETAINED AT THE
END OF EACH FISCAL YEAR IN THE MOTORCYCLE SAFETY PROGRAM ACCOUNT
FOR USE DURING SUBSEQUENT YEARS.
[(c)] (D) The Administration is authorized to and shall
award contracts out of the appropriation to the Department from
the Motorcycle Safety Program Account to qualifying motorcycle
safety training centers for the conduct of approved motorcycle
safety courses.
[(d)] (E) The fees deposited in the Motorcycle Safety
Program Account are not subject to the provisions of Title 8,
Subtitle 4 of this article, on the disposition of highway user
revenues.
[(e)] (F) (1) From its share of the Transportation Trust
Fund, the Department shall provide in its annual budget for those
funds that together with the funds credited to the Motorcycle
Safety Program Account in the Transportation Trust Fund, will be
sufficient to fund the cost of the program, INCLUDING
ADMINISTRATIVE COSTS. THE DEPARTMENT MAY PAY A DIRECT SUBSIDY TO
A MOTORCYCLE SAFETY TRAINING CENTER at a rate not to exceed $50
for each eligible person completing the course.
(2) The funds provided under this section shall be in
addition to any other State aid.
(3) The Department shall not contract for the
provision of any services under this program the aggregate costs
of which exceed the funds credited to the Motorcycle Safety
Program Account in the Transportation Trust Fund.
Chapter 674 of the Acts of 1983
SECTION 2. AND BE IT FURTHER ENACTED, That, subject to
[Article 40, Section 51 of the Code] Section 2-1312 of the State
Government Article, the Department shall prepare and submit to
the General Assembly, on or before February 1 of each year, a
full report of the operation of the Motorcycle Safety Program for
the preceding fiscal year. The General Assembly shall evaluate
the cost effectiveness of the Motorcycle Safety Program in
Maryland and the validity of continuing financial support of this
program by the State. Unless action to the contrary is taken by
July 1, [1986] 1988, the provisions of this Act are hereby
repealed effective July 1, [1987] 1989.
