of racing be held in any one year on any one track within the
State of Maryland. Provided, the limitation in this subsection
shall not be applicable to or include the 48 days granted to the
Commission in subsection (b) of this section to be awarded in its
discretion OR THE 42 32 DAYS AUTHORIZED TO BE AWARDED BY THE
COMMISSION UNDER SUBSECTION (F) OF THIS SECTION.

(F) (1) FOR CALENDAR YEAR 1985 AND ALL SUBSEQUENT YEARS,
THE COMMISSION SHALL AWARD 32 OF THE 42 DAYS THAT WERE AWARDED IN
CALENDAR YEAR 1984 TO THE MARYLAND STATE FAIR AND AGRICULTURAL
SOCIETY, INCORPORATED, FOR RUNNING AT THE TIMONIUM TRACK, IN
EQUAL NUMBERS OF DAYS TO THE TRACKS THAT ARE AUTHORIZED BY THIS
SECTION TO CONDUCT MILE RACING IN THE STATE.

(2)  THE DAYS AWARDED UNDER THIS SUBSECTION SHALL BE
SUBJECT TO ALL OF THE PROVISIONS OF THIS ARTICLE APPLICABLE TO
MILE RACING DAYS.

(3)  THE AWARD OF ANY RACING DAYS BY THE COMMISSION
UNDER THIS SUBSECTION OR UNDER ANY OTHER PROVISION OF THIS
ARTICLE (F) CONSTITUTES A LICENSE OF THESE DAYS TO THE TRACKS TO
WHICH THE DAYS ARE AWARDED AND DOES NOT PROVIDE ANY RIGHT OF
OWNERSHIP IN THE DAYS TO ANY TRACK OR ANY OTHER PERSON.

15.

(a) In addition to licensing racing, as hereinbefore
provided, the Racing Commission is authorized to issue licenses
to the [following organizations: the Maryland State Fair and
Agricultural Society, Incorporated shall be permitted to conduct
a race meeting with betting privileges, not to exceed forty-two
(42) 10 days in any calendar year. Eighteen of the days assigned
to the Maryland State Fair and Agricultural Society, Incorporated
may be withdrawn by the Commission if the licensee fails to
provide an improvement program prescribed by the Commission, but,
if these days are withdrawn, they shall not be awarded elsewhere.
The] Agricultural and Mechanical Association of Washington
County and the Southern Maryland Agricultural Fair Association of
Prince George's County. [each] EACH shall be permitted to
conduct a race meeting with betting privileges, not to exceed
eighteen days in any calendar year. [The Maryland State Fair
and Agricultural Society, Incorporated meeting must be held in
connection with or for the benefit of bona fide county fairs or
agricultural exhibitions and be held in compliance with all the
provisions of this article.] The award of all dates shall
constitute a license and not a franchise.

(E) FOR CALENDAR YEAR 1985 AND ALL SUBSEQUENT YEARS, THE
COMMISSION MAY NOT AWARD ANY MORE THAN 10 DAYS OF RACING UNDER
THIS SECTION TO THE MARYLAND STATE FAIR AND AGRICULTURAL SOCIETY,
INCORPORATED. THIRTY TWO OF THE DAYS OF RACING AWARDED UNDER
THIS SECTION TO THE MARYLAND STATE FAIR AND AGRICULTURAL SOCIETY,
INCORPORATED, FOR CALENDAR YEAR 1984 SHALL BE AWARDED IN ALL
SUBSEQUENT YEARS ACCORDING TO THE PROVISIONS OF § 7(F) OF THIS
ARTICLE. THE DAYS AWARDED UNDER § 7(F) SHALL NOT BE RUN AS
HALF-MILE DAYS.
