Article 88B - State Police
23C.

(A)  THERE IS A SICK LEAVE RESERVE.

(B)  THE SUPERINTENDENT OF STATE POLICE SHALL ADMINISTER THE
SICK LEAVE RESERVE.

(C)  WITH THE APPROVAL OF THE SUPERINTENDENT OF STATE
POLICE, ANY POLICE EMPLOYEE MAY DONATE UP TO 2 DAYS OF SICK LEAVE
EACH YEAR TO THE SICK LEAVE RESERVE.

(D)  THE SUPERINTENDENT MAY TRANSFER DAYS OF SICK LEAVE THAT
HAVE BEEN ACCUMULATED IN THE SICK LEAVE RESERVE TO ANY POLICE
EMPLOYEE WHO:

(1)  HAS A DOCUMENTED MEDICAL DISABILITY; AND

(2)  HAS EXHAUSTED ALL FORMS OF LEAVE; AND .

(3) IS NOT ELIGIBLE FOR EXTENDED SICK LEAVE UNDER
ARTICLE 64A, § 37(E) OF THE CODE.

(E)(1) THE TOTAL NUMBER OF DAYS OF SICK LEAVE TRANSFERRED
TO A POLICE EMPLOYEE UNDER THIS SECTION MAY NOT EXCEED THE TOTAL
NUMBER OF LEAVE DAYS PERMITTED UNDER ARTICLE 64A, § 37(E) OF THE
CODE.

(E) THE SUPERINTENDENT SHALL ADOPT RULES AND REGULATIONS
CONCERNING A MEMBER'S ELIGIBILITY TO WITHDRAW SICK LEAVE FROM THE
RESERVE INCLUDING:

(1) A REQUIREMENT THAT THE MEMBER HAS A LONG TERM
ILLNESS AND IS UNABLE TO WORK; AND

(2) THE LENGTH OF TIME FOR WHICH A MEMBER MAY RECEIVE
SICK LEAVE.

(2) (F) THE SUPERINTENDENT OF STATE POLICE MAY NOT
TRANSFER ANY SICK LEAVE UNDER THIS SECTION TO A POLICE EMPLOYEE
WHO HAS BEEN GRANTED DISABILITY RETIREMENT BY THE BOARD OF
TRUSTEES OF THE STATE RETIREMENT SYSTEMS FOR USE AFTER THE FIRST
DATE ON WHICH DISABILITY RETIREMENT BEGINS MAY BECOME EFFECTIVE.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
