to review Article 21 and to make recommendations for
simplification and improvement of State procurement generally;
and
WHEREAS, The ad hoc subcommittee in September, 1983,
reported to the Board of Public Works and the General Assembly
its view that human, social, cultural, and educational services
can and should be procured under a modified Article 21 and Title
21 and members of the subcommittee subsequently agreed that many
of the problems it identified in the procurement of human,
social, cultural, and educational services agreements under
Article 21 were adequately addressed by the recommendations and
proposed legislation of the ad hoc committee chaired by the State
Treasurer; and
WHEREAS, Additional rulemaking to accommodate the effective
procurement of human, social, cultural, and educational services
is needed; and
WHEREAS, It is the policy of the State to promote continuity
and quality of care as well as cost effectiveness in the
procurement of human and social services; and
WHEREAS, The ad hoc subcommittee and others have also
expressed concern that procurements of human and social services
by the Departments of Human Resources and Health and Mental
Hygiene should be made, as soon as possible, in accordance with
program standards published in COMAR the Maryland Register; and
WHEREAS, The Departments of Human Resources and Health and
Mental Hygiene have expressed their intention to adopt develop
such program standards with all deliberate speed by January 1,
1985 and meanwhile to make procurements in accordance with
interim written guidelines that have been developed with input
from after consultation with the provider community; now,
therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Chapter 141 of the Acts of 1982, as amended
by Chapter 628 of the Acts of 1983
SECTION 2. AND BE IT FURTHER ENACTED, That the additional
regulations required by this Act shall be adopted by June 30,
[1984] 1985. Until until June 30, [1984] 1985, the acquisition
of human, cultural, social, and educational services is not
subject to the provisions of Article 21.
SECTION 3. AND BE IT FURTHER ENACTED, That the Secretaries
of the Departments of Health and Mental Hygiene and Human
Resources and the Executive Director of the Office on Aging shall
publish proposed regulations pertaining to program standards for
