Ch. 289

Secretary-Treasurer shall credit the appropriate account with the
collection of special benefit assessments [upon] the LISTED
properties [listed thereon and, as]. AS required by any
resolution of the Commission [authorizing] THAT AUTHORIZES THE
bonds, [he] THE SECRETARY-TREASURER shall periodically deduct
from each such account its proportionate share of principal and
interest due on THE bonds, determined by the Commission pursuant
to subsection (a) [hereof]. (1957 Code, sec. 539. 1957 ch. 694,
sec. 885; 1961, ch. 743, sec. 539; 1963, ch. 825, sec. 24.)

28-13. Ad valorem taxes.

(a) Levy. In order to provide the District with funds to
WHOLLY OR PARTIALLY pay[, in whole or in part,] the cost of any
project or projects in a sub-district or to WHOLLY OR PARTIALLY
pay[, in whole or in part,] the maturing principal of or interest
on any bonds issued [by the District,] pursuant to Section 28-7
[of this subtitle,] BY THE DISTRICT for a project or projects in
[such] THAT sub-district, the County [shall], when requested by
the Commission, SHALL levy annually upon all property subject to
unlimited County taxation in [such] THAT sub-district an ad
valorem tax in A rate and amount sufficient to provide [such] THE
funds [as may be] needed by the Commission for either or both of
the foregoing purposes[, the]. THE annual rate of any such ad
valorem tax [to] SHALL be determined, from year to year, in the
following manner[.]:

(1)  At least [sixty] 60 days before the beginning of
each COUNTY fiscal year [of the County], the County Treasurer
shall certify to the Commission the amount of all uncollected
assessments, charges or taxes, whether or not delinquent, THAT
WERE imposed or levied in the sub-district[,] AND which he
estimates he will be able to collect in the current or in the
next ensuing fiscal year of the County;

(2)  The Commission shall then determine and estimate
the amounts needed for expenditure on either or both of the
foregoing purposes and the total of the amounts available for
[such] THAT expenditure which are on hand or which it [may
anticipate] ANTICIPATES collecting to meet [such] THE expenditure
from special benefit assessments, water service charges, sewer
service charges, assessments in aid of construction, uncollected
accounts reported pursuant to subparagraph (1) above, or from any
other source;

(3)  The Commission shall then deduct [such] THAT
total from the amounts [so] needed and the difference, if any,
shall be the amount to be raised by the levy of [said] THE ad
valorem tax in [said] THE sub-district in the ensuing fiscal
year.

(4)   [Thereupon, the] THE Commission shall certify
[such] THAT amount to the County, which shall fix and levy [such]
THE ad valorem tax at a rate sufficient to produce the required
amount.
