Subsection (b)(4) of this section also is added as
standard language. It follows from the requirement
that there be staggered terms. An inherent aspect of
staggered terms is that they must begin and end at set
intervals. For circumstances under which subsection
(b)(4) of this section applies, see the General
Revisor's Note to this article.

Subsection (a)(2)(i) of this section is revised to
provide that either the Governor or a designee of the
Governor is always a member of the Commission. The
second sentence of former Art. 41, § 360(b), which
enabled the Governor to "designate from time to time
himself or ... the Secretary of State", could be read
to include the Governor, or designee, as a member only
when the Governor chose. This reading seemed
unintended.

9-404. OFFICERS.

FROM AMONG THE APPOINTED MEMBERS OF THE COMMISSION, THE
GOVERNOR SHALL APPOINT A CHAIRMAN.

the first sentence of former Art. 41, § 360(b).

9-405. MEETINGS; COMPENSATION; OFFICES; STAFF.

(A)  MEETINGS.

(1)  THE COMMISSION SHALL DETERMINE THE TIMES AND
PLACES OF ITS MEETINGS.

(2)  THE PRESIDENT MAY DESIGNATE ANY SENATOR TO
REPRESENT THE PRESIDENT AT A MEETING.

(3)  THE SPEAKER MAY DESIGNATE ANY DELEGATE TO
REPRESENT THE SPEAKER AT A MEETING.

(B)  COMPENSATION AND REIMBURSEMENT FOR EXPENSES.
