(VII)  THE MAYOR OF ANNAPOLIS; AND

(VIII)  THE SUPERINTENDENT OF THE UNITED STATES
NAVAL ACADEMY.

(B) TENURE; VACANCIES.

(1)  THE TERM OF AN APPOINTED MEMBER IS. 4 YEARS.

(2)  THE TERMS OF THE APPOINTED MEMBERS ARE STAGGERED
AS REQUIRED BY THE TERMS PROVIDED FOR APPOINTED MEMBERS OF THE
COMMISSION ON OCTOBER 1, 1984.

(3)  AT THE END OF A TERM, AN APPOINTED MEMBER
CONTINUES TO SERVE UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN
SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A SUCCESSOR IS
APPOINTED AND QUALIFIES.

(5)  AN APPOINTED MEMBER MAY NOT SERVE CONSECUTIVELY
MORE THAN 2 4-YEAR TERMS.

REVISOR'S NOTE: Subsections (a) and (b)(1) and (5) of this
section are new language derived without substantive
change from the second sentence and first clause of
the first sentence of former Art. 41, § 360(b) and the
first and fourth sentences of (c).

Subsection (b)(2) of this section is new language
added to reflect the continuing stagger created under
the second, third, and fifth sentences of former Art.
41, § 360(c), which specified the initial terms of
appointed members and which are deleted as obsolete.
The terms of the members on October 1, 1984 end as
follows: (1) 2 in 1985; and (2) 3 in 1987.

Subsection (b)(3) of this section is standard language
added to avoid gaps in membership by providing that a
member serves until a successor takes office. This
provision is supported by the cases of Benson v.
Mellor, 152 Md. 481 (1927) and Grooms v: LaVale Zoning
Board, 27 Md. App. 266 (1975).
