Although the second clause of the introductory
language of former Art. 41, § 483(d), which referred
to "constraints of law ... that govern ... other State
agencies", literally could be read to apply to this
section, the former clause seemed intended to apply
only to the other items in former Art. 41, § 483(d).
Therefore, the former clause is omitted in this
section. Cf. §§ 9-304 and 9-305. of this subtitle.

SUBTITLE 4. COMMISSION ON THE CAPITAL CITY.

9-401. "COMMISSION" DEFINED.

IN THIS SUBTITLE, "COMMISSION" MEANS THE STATE COMMISSION ON
THE CAPITAL CITY.

REVISOR'S NOTE: This section is new language added to avoid
repetition of the full name "State Commission on the
Capital City".

9-402. ESTABLISHED.

THERE IS A STATE COMMISSION ON THE CAPITAL CITY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §
360(a).

It is set forth as a separate section for emphasis.

The word "State" is substituted for the former word
"Maryland", to standardize the references to State
units.

The former reference to "the membership, powers and
duties here provided" is deleted as surplusage.

9-403. MEMBERSHIP.

(A) COMPOSITION; APPOINTMENT OF MEMBERS.

THE COMMISSION CONSISTS OF:

(1)   5 INDIVIDUALS APPOINTED BY THE GOVERNOR; AND

(2)  AS EX OFFICIO MEMBERS:

(I)  THE GOVERNOR OR, AS A DESIGNEE, THE
LIEUTENANT GOVERNOR OR SECRETARY OF STATE;

(II)  THE PRESIDENT OF THE SENATE;
