(5) KNOWINGLY TRANSFER A COUNTERFEIT OR ALTERED STATE
LOTTERY TICKET OR SHARE TO ANOTHER PERSON TO PRESENT FOR PAYMENT.

PENALTIES.

A PERSON WHO VIOLATES ANY PROVISION OF SUBSECTION (B) OF
THIS SECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS
SUBJECT TO A FINE NOT EXCEEDING $2,500 OR IMPRISONMENT NOT
EXCEEDING 3 YEARS OR BOTH.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 88D, §§
13, 14, and 14A.

In subsection (b)(1) through (3) of this section, the
words "State lottery" are added to modify the
references to a "ticket or share", to conform to
subsection (b)(4) and (5) of this section. These
additions are based on former Art. 88D, § 3(c), which
defined "[l]ottery" to mean the State lottery. These
additions assume that subsection (b)(1) of this
section was not intended to be read as a general
prohibition against sale of any lottery tickets or
shares since Art. 27, §§ 356 through 371A of the Code
generally prohibit sales of other than State lottery
tickets and would apply even to a licensed agent.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 88D, § 1.

GENERAL REVISOR'S NOTE:

Former Art. 88D, § 2, which stated that former Art. 88D
would be implemented by establishment of the State lottery, is
deleted since the State lottery has been established.

Former Art. 88D, § 22 is deleted as unnecessary in light of
the severability provisions in Art. 1, § 23 of the Code.

Former Art. 88D, § 23, which repealed laws inconsistent with
former Art. 88D, is deleted as unnecessary in light of § 9-102
of this subtitle.

Former Art. 88D, § 24, which provided for the Agency to
issue State premium savings bonds, is deleted since the former
section has not been implemented although enacted by Ch. 872,
