Subsection (c)(2) of this section is new language
added to reflect the continuing stagger created under
the second clause of the second sentence of former
Art. 88D, § 5(a), which specified the terms of the
initial members and is deleted as obsolete.

The terms of the members serving on October 1, 1984
end as follows: (1) 2 in 1985; (2) 1 in 1986; (3) 1
in 1987; and (4) 1 in 1988.

Subsection (c)(3) of this section is standard language
added to avoid gaps in membership by providing that a
member serves until a successor takes office. This
provision is supported by the cases of Benson v.
Mellor, 152 Md. 481 (1927) and Grooms v. LaVale Zoning
Board, 27 Md. App. 266 (1975).

In subsection (c)(4) of this section, the former
limitation "in the same manner as for an original
appointment" is deleted as surplusage.

9-106. CHAIRMAN.

FROM AMONG ITS MEMBERS, THE COMMISSION ANNUALLY SHALL ELECT
A CHAIRMAN.

9-107. DIRECTOR.

(A)  POSITION AND APPOINTMENT.

WITH THE ADVICE AND CONSENT OF THE SENATE, THE GOVERNOR
SHALL APPOINT THE DIRECTOR OF THE AGENCY, WHO IS THE EXECUTIVE
OFFICER OF THE AGENCY AND SECRETARY OF THE COMMISSION.

(B)  RESPONSIBILITY TO GOVERNOR.

THE DIRECTOR SERVES AT THE PLEASURE OF THE GOVERNOR.

(C)  QUALIFICATIONS.

THE DIRECTOR MUST HAVE THE TRAINING AND EXPERIENCE NEEDED TO
DIRECT THE WORK OF THE AGENCY.

(D)  FULL-TIME DUTIES.

THE DIRECTOR SHALL DEVOTE FULL TIME TO THE DUTIES OF OFFICE
AND MAY NOT ENGAGE IN ANOTHER PROFESSION OR OCCUPATION.
