THERE IS A STATE LOTTERY COMMISSION IN THE AGENCY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second clause of
former Art. 88D, § 4, as that clause related to the
Commission.

The provisions of the second clause of former Art.
88D, § 4 that related to the Director are deleted as
unnecessary in light of § 9-107(a) and (e) of this
subtitle.

Defined term: "Agency" § 9-101

9-105. MEMBERSHIP OF COMMISSION.

(A)  COMPOSITION; APPOINTMENT OF MEMBERS.

THE COMMISSION CONSISTS OF '5 MEMBERS APPOINTED BY THE
GOVERNOR WITH THE ADVICE AND CONSENT OF THE SENATE.

(B)  QUALIFICATIONS.

EACH MEMBER OF THE COMMISSION MUST BE A RESIDENT AND CITIZEN
OF THE STATE.

(C)  TENURE; VACANCIES.

(1)  THE TERM OF A MEMBER IS 4 YEARS.

(2)  THE TERMS OF MEMBERS ARE STAGGERED AS REQUIRED BY
THE TERMS PROVIDED FOR MEMBERS OF THE COMMISSION ON OCTOBER 1,
1984.

(3)  AT THE END OF A TERM, A MEMBER CONTINUES TO SERVE
UNTIL A SUCCESSOR IS APPOINTED AND QUALIFIES.

(4)  A MEMBER WHO IS APPOINTED AFTER A TERM HAS BEGUN
SERVES ONLY FOR THE REST OF THE TERM AND UNTIL A SUCCESSOR IS
APPOINTED AND QUALIFIES.

(D)  REMOVAL.

(1)   SUBJECT TO THE HEARING REQUIREMENTS OF THIS
SUBSECTION, THE GOVERNOR MAY REMOVE A MEMBER FOR CAUSE.

(2)  BEFORE THE GOVERNOR REMOVES A MEMBER, THE
GOVERNOR SHALL GIVE THE MEMBER NOTICE AND AN OPPORTUNITY FOR A
PUBLIC HEARING.

REVISOR'S NOTE: Subsections (a), (b), (c)(1) and (4), and
(d) of this section are new language derived without
substantive change from former Art. 88D, § 5(b) and
(c) and the first sentence and the first clause of the
second sentence of (a).
