(2) THE SECRETARY OF STATE MAY CERTIFY TO THE
QUALIFICATION OF A CIVIL OFFICER TO THE SAME EXTENT THAT A CLERK
OF COURT MAY CERTIFY.

(C) LISTS FOR GENERAL ASSEMBLY.

(1)  THIS SUBSECTION APPLIES ONLY TO CIVIL OFFICERS
WHOM THE GOVERNOR APPOINTS SUBJECT TO THE APPROVAL OF THE SENATE
OR THE HOUSE OF DELEGATES.

(2)  IN JANUARY OF EACH YEAR, THE SECRETARY OF STATE
SHALL MAKE:

(I)  A LIST THAT INCLUDES THE NAME, POSITION,
TERM OF OFFICE, AND SALARY OF EACH CIVIL OFFICER WHOM THE
GOVERNOR APPOINTED DURING THE PRECEDING CALENDAR YEAR; AND

(II)  A LIST THAT INCLUDES THE NAME, POSITION,
TERM OF OFFICE, AND SALARY OF EACH CIVIL OFFICER WHOSE TERM
EXPIRES DURING THE CURRENT CALENDAR YEAR.

(3)  THE SECRETARY SHALL:

(I)  SEND A COPY OF EACH LIST TO EACH MEMBER OF
THE GENERAL ASSEMBLY; AND

(II)  MAKE THE LIST AVAILABLE TO ANY PERSON WHO
REQUESTS THE LIST.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §§ 86
and 87.

In subsection (a)(2) of this section, the reference to
the "individual before whom the officer is to qualify"
is substituted for the former reference to "clerks of
the circuit courts for the counties", to reflect that
some officers are required, by law, to qualify before
individuals other than clerks of court. See Art. 70
of the Code.

In subsection (b)(1) of this section, the language "as
provided by law" is added as a general reference to
Art. 17, § 71 and Art. 70, § 12 of the Code, which
require clerks of court to file reports monthly.

In subsection (b)(2) of this section, the former
reference to certification as to the "character" of a
civil officer is deleted to conform to Art. 17, § 72
of the Code, which requires a clerk of court to
provide a certificate "of the qualification" of an
officer.
