LAWS OF MARYLAND

Ch. 284

In subsection (c) of this section, the former language
"a matter of public record" is deleted as unnecessary
in light of subsection (c)(3) of this section.

Defined terms: "Includes";"including" § 1-101
"Person" § 1-101

7-106. AUTHENTICATION OF RECORDS.

(A)  SEAL REQUIRED.

THE SECRETARY OF STATE SHALL HAVE A SEAL FOR THE
AUTHENTICATION OF COPIES OF RECORDS IN THE OFFICE OF THE
SECRETARY.

(B)  FEES.

EXCEPT AS OTHERWISE PROVIDED BY LAW, THE SECRETARY OF STATE
MAY CHARGE A PERSON:

(1)  FOR THE AUTHENTICATION OF A COPY OF A RECORD IN
THE CUSTODY OF THE SECRETARY, A FEE OF NOT MORE THAN $5; AND

(2)  IF THE PERSON DOES NOT PROVIDE THE COPY FOR
AUTHENTICATION, 50 CENTS A PAGE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, § 85
and the first clause of § 84.

In subsection (b) of this section, the former,
specific reference to "firms and corporations" and the
former exception for "bureaus ... of political
subdivisions thereof" are deleted as unnecessary in
light of the usual construction of the defined term
"person".

The second clause of former Art. 41, § 84, which
prohibited provision of a copy of a gubernatorial
document without the approval of the Governor, is
deleted as obsolete, since the former clause, which
was enacted by Ch. 448, Acts of 1853, is never used.
In practice, the Office of the Secretary of State
routinely provides copies of these documents, in
accordance with the intent of §§ 10-612 and 10-620 of
this article.

Defined term: "Person" § 1-101

SUBTITLE 2. DIVISION OF STATE DOCUMENTS.
