Ch. 284

The references to an "Assistant Secretary" are
substituted for the former reference to "an assistant
to the Secretary", to conform to Art. 64A, § 8A of the
Code, which was enacted by Ch. 234, Acts of 1965.
That Chapter also amended former Art. 41, § 89 and, by
its title, intended to "provide for the permanent
office of Assistant Secretary of State under the merit
system."

7-103. POWERS AND DUTIES.

IN ADDITION TO THE POWERS GRANTED AND DUTIES IMPOSED
ELSEWHERE, THE SECRETARY OF STATE HAS THE POWERS AND DUTIES SET
FORTH IN THIS SUBTITLE.

REVISOR'S NOTE: This section is new language added to
indicate clearly that the powers and duties enumerated
in this subtitle are not exclusive.

7-104. INTERSTATE COMPACTS.

EACH INTERSTATE COMPACT INTO WHICH THE STATE ENTERS SHALL BE
KEPT IN THE OFFICE OF THE SECRETARY OF STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, § 46A.

The phrase "into which the State enters" is added to
modify "compact", to clarify the scope of this
section.

The former reference to keeping the compacts "for
public record" is deleted as unnecessary since, absent
statutory provisions to the contrary, records of a
State officer are public. See § 10-612 of this
article.

7-105. RECORDS ON CIVIL OFFICERS.

(A)  COMMISSIONS.

THE SECRETARY OF STATE SHALL:

(1)  KEEP A BOOK IN WHICH THE SECRETARY RECORDS EACH
COMMISSION THAT THE GOVERNOR ISSUES TO A CIVIL OFFICER; AND

(2)  SEND THE COMMISSION OF EACH CIVIL OFFICER TO THE
INDIVIDUAL BEFORE WHOM THE OFFICER IS TO QUALIFY.

(B)  QUALIFICATION.

(1) THE SECRETARY OF STATE SHALL KEEP THE RECORDS ON
QUALIFICATION OF CIVIL OFFICERS THAT THE CLERKS OF COURT FILE AS
PROVIDED BY LAW.
