32A, § 9 by Ch. 560, Acts  of   1916. Later amendments

of former Art. 32A, § 9   --  by Ch. 129, Acts of 1959,

and Ch. 619, Acts of 1979   --  merely affected the name
of the State Law Library.

In subsection (a)(3) of this section, the reference to
the "session laws" is substituted for the former
reference to the "acts of the General Assembly of
Maryland", for brevity and for conformity to other
references in this article.

TITLE 7. SECRETARY OF STATE.

SUBTITLE 1. GENERAL PROVISIONS.

7-101. POSITION IN EXECUTIVE DEPARTMENT.

(A)  POSITION.

THERE IS A SECRETARY OF STATE, AS PROVIDED IN ARTICLE II, §
22 OF THE MARYLAND CONSTITUTION.

(B)  ASSIGNMENT.

THE SECRETARY OF STATE IS IN THE EXECUTIVE DEPARTMENT.

REVISOR'S NOTE: Subsection (a) of this section is new
language added as a general reference to the
Constitutional provision that creates the position of
Secretary of State.

Subsection (b) of this section is new language derived
without substantive change from the first sentence of
former Art. 41, § 83.

The second sentence of former Art. 41, § 83, which
generally referred to the "rights ... conferred by
law", is deleted as surplusage.

7-102. ASSISTANT SECRETARY.

(A)  APPOINTMENT AUTHORIZED.

THE GOVERNOR MAY APPOINT AN ASSISTANT SECRETARY OF STATE.

(B)  POWERS.

IF THE SECRETARY OF STATE IS ABSENT FROM THE SEAT OF THE
STATE GOVERNMENT OR ILL, THE ASSISTANT SECRETARY MAY CARRY OUT
ANY DUTY THAT IS IMPOSED BY LAW ON THE SECRETARY.
